• Session refers to any scheduled or on-demand learning interaction, including group classes and individual lessons conducted via the Platform.
• Instructor refers to any qualified individual engaged by Ryxiqia to deliver educational content or conduct Sessions.
• Subscription refers to a paid plan that grants access to specific features, content, or services for a defined period.

2. Acceptance of Terms

By creating an Account, enrolling in any course or Session, or otherwise using the Platform, you enter into a binding agreement with Ryxiqia under these Terms of Use. These terms apply to all visitors, registered users, and anyone who accesses any part of the Platform.

We reserve the right to update or modify these terms at any time. Changes will be posted on this page with a revised date. Continued use of the Platform after any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.

If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

3. Eligibility

To use the Platform, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. If you are under the required age, you may only use the Platform with the involvement and consent of a parent or legal guardian who agrees to these terms on your behalf.

4.1 Creating an Account

5. Use of the Platform

5.1 Permitted Use

You may use the Platform solely for lawful personal educational purposes in accordance with these terms. You agree to use the Platform in a manner consistent with all applicable laws and regulations.

5.2 Prohibited Conduct

You must not:

• Copy, reproduce, distribute, or publicly display any Content without prior written permission from Ryxiqia.
• Attempt to reverse engineer, decompile, or extract source code from any part of the Platform.
• Use automated tools, bots, scrapers, or scripts to access or collect data from the Platform.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Upload, post, or transmit any material that is harmful, defamatory, obscene, fraudulent, or otherwise objectionable.
• Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure.
• Attempt to gain unauthorised access to any part of the Platform, other Accounts, or systems connected to the Platform.
• Use the Platform for any commercial purpose without our express written consent.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform.
• Share, resell, or sublicense access to your Account or any Session to third parties.

5.3 User-Generated Content

If you submit, post, or share any content through the Platform, including messages, feedback, or contributions during Sessions, you grant Ryxiqia a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display such content solely for the purpose of operating and improving the Platform. You retain ownership of your content and are solely responsible for ensuring it does not infringe any third-party rights.

6. Educational Services and Sessions

6.1 Group and Individual Sessions

The Platform offers both group-based and individual learning Sessions. Session availability, scheduling, and format are subject to change at our discretion. We will endeavour to provide reasonable advance notice of any significant changes to scheduled Sessions.

6.2 Session Conduct

During any Session, you agree to behave respectfully toward Instructors and other participants. Disruptive, abusive, or inappropriate behaviour may result in removal from the Session and suspension of your Account without refund.

6.3 Recording of Sessions

Sessions may be recorded by Ryxiqia for quality assurance, review, and improvement purposes. By participating in a Session, you consent to such recording. You must not record any Session yourself without the explicit written consent of Ryxiqia and all other participants.

6.4 Learning Outcomes

While we strive to provide high-quality educational experiences, we make no guarantee of specific learning outcomes, results, or professional advancement as a result of using the Platform or completing any course or Session.

7. Payments and Subscriptions

7.1 Fees

Access to certain features, courses, or Sessions may require payment. All applicable fees are displayed on the Platform prior to purchase. By completing a purchase, you authorise us to charge the specified amount to your chosen payment method.

7.2 Billing

Subscription fees are billed on a recurring basis at the frequency selected at the time of purchase. You are responsible for ensuring that your payment information remains current and accurate.

7.3 Cancellation

You may cancel a Subscription at any time through your Account settings. Cancellation will take effect at the end of the current billing period. You will retain access to Subscription features until that date.

7.4 Refunds

Refund eligibility is determined by the specific refund policy applicable to the product or service purchased, as described at the point of sale. Unless otherwise stated, payments for completed Sessions or consumed digital content are non-refundable.

7.5 Price Changes

We reserve the right to modify pricing at any time. Changes to Subscription pricing will be communicated in advance and will take effect at the start of the next billing cycle following notification.

8. Intellectual Property

8.1 Ownership

All Content available on the Platform, including course materials, videos, text, graphics, software, and design elements, is the property of Ryxiqia or its licensors and is protected by applicable intellectual property laws. Nothing in these terms grants you any ownership rights over such Content.

8.2 Limited Licence

Subject to your compliance with these terms, Ryxiqia grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal, non-commercial educational purposes.

8.3 Restrictions

You must not reproduce, distribute, modify, create derivative works from, publicly perform, or otherwise exploit any Content without our prior written consent. Unauthorised use of Content may constitute an infringement of intellectual property rights and may result in legal action.

8.4 Feedback

If you provide feedback, suggestions, or ideas regarding the Platform, you grant Ryxiqia an unrestricted, perpetual, royalty-free licence to use such feedback for any purpose without obligation or compensation to you.

9. Privacy and Data

10. Third-Party Services and Links

We have no control over and accept no responsibility for the content, privacy practices, or terms of any third-party service. Your use of third-party services is entirely at your own risk and subject to their respective terms.

11. Disclaimers

The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Ryxiqia disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any Content available on the Platform.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Ryxiqia and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or its Content, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising from or related to these terms or your use of the Platform exceed the total amount paid by you to Ryxiqia in the twelve months preceding the event giving rise to the claim, or €100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ryxiqia and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these terms, or your infringement of any third-party rights.

14. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.

15. Termination

These terms remain in effect for as long as you use the Platform or maintain an Account. We may terminate or suspend your access to the Platform immediately, without prior notice, if you breach any provision of these terms or if we are required to do so by law.

Upon termination, all licences granted to you under these terms will immediately cease. Provisions that by their nature should survive termination, including but not limited to intellectual property rights, disclaimers, limitation of liability, and indemnification, shall continue to apply.

16. Governing Terms

These Terms of Use constitute the entire agreement between you and Ryxiqia with respect to your use of the Platform and supersede all prior agreements, understandings, or representations relating to the same subject matter.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
